Bicyclist Succumbs to Injuries Three Days Post Collision; DUI Driver Among Two Involved [Las Vegas]

LAS VEGAS — A tragic incident unfolded on July 2, when a driver, now facing DUI charges, struck a bicyclist. The bicyclist succumbed to his injuries three days after the crash, as confirmed by Las Vegas Metropolitan Police.

The crash took place around midnight on South Nellis Boulevard, just south of Desert Inn Road. Police reports indicate that the bicyclist, identified as 59-year-old David Brooks, was riding against traffic in the southbound lanes of Nellis.

Brooks crossed the center median and moved into the path of a northbound Dodge Dakota. The collision with the Dodge threw Brooks into the southbound lanes, where he was subsequently hit by another vehicle.

Following the accident, Brooks was rushed to Sunrise Hospital and Medical Center in critical condition. Despite the medical team’s efforts, he tragically passed away on July 5.

The driver of the Dodge, 44-year-old Anthony Wayne Tate, was arrested on suspicion of DUI and booked into the Clark County Detention Center. The other driver involved in the accident remained at the scene and showed no signs of impairment.

Court records reveal that Tate is facing multiple charges, including possession of a controlled substance, DUI, and a driver’s license violation. Following his arrest, Tate was released from detention the day after the crash, under the condition that he not drive without a valid driver’s license.

Records also show Tate’s history of arrests on drug charges and driving without a valid license. His most recent arrest in 2019 was resolved on July 8 with a plea deal, where he was credited for time served, and the state did not seek additional jail time.

This incident marks the 85th traffic-related fatality in the jurisdiction of the Las Vegas Metropolitan Police for 2024. The heartbreaking loss of David Brooks underscores the devastating impact of impaired driving and raises critical questions about road safety and legal accountability.

In cases like this, the victims’ families can seek various forms of compensation. These compensations can include medical expenses, funeral costs, loss of income, and pain and suffering. The victims’ families must have experienced legal representation to navigate the complexities of these claims.
